BILLING POLICY 

 

Definition of Accounts and Services
You represent that you are an adult 18 years of age or older or, if under 18 years of age, that you have the consent of a parent or guardian.

An Account is a billing account set up by a registered user for the purposes of accessing the Services (all in-game, game-related, and Web site-related services offered by YNK Interactive (YNK)). Only one person may use an Account. The registered user of an Account may use the Account or may choose instead to permit a minor child of the registered user to use the Account. You are liable for all activities conducted through your Account, and parents or guardians are liable for all activities of their minor child conducted through the Account.

Registration Obligations
You agree to provide true, accurate, current and complete information about yourself as prompted by the Services’ registration form (Registration Data) and maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or YNK has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, YNK has the right to suspend or terminate your Account and refuse any and all current or future use of the Services.

Rights to Use Accounts
By agreeing to the Terms of Service, you agree that you do not own the Account you use to access the Services and that YNK stores on YNK servers, the characters or items stored on these servers, or any other data acting as components of such servers and accounts. The Account you create is needed to login to the service.

Names
You must choose an account name (Account ID) to identify yourself to YNK staff on the Account. You may not select as your Account ID the name of another person, or a name which violates any third party's trademark right, copyright, or other proprietary right, or which may mislead other players to believe you to be an employee of YNK or its affiliated companies, or which YNK deems in its sole discretion to be vulgar or otherwise offensive. YNK reserves the right, in its sole discretion, to (1) delete or alter any Account ID; (2) terminate any license granted herein, for any reason whatsoever, including, without limitation, any suspected or actual infringement of any trademark or trade name right, copyright, or other proprietary right; or (3) delete any content published on any forums without notice. You are solely liable for all activities conducted through your Account or under your Account ID.

In order to use the Services, you must create a character and choose a name (Character Name) for your character to identify your character to other users and a guild name, if applicable. You may not select as your character or guild name the name of another person, or a name which violates any third party's trademark right, copyright, or other proprietary right, or which may mislead other players to believe you to be an employee of YNK, or which YNK deems at its sole discretion to be vulgar or otherwise offensive. YNK reserves the right, in its sole discretion, to (1) delete or alter any Character Name or (2) terminate any license granted herein, for any reason whatsoever, including, without limitation, any suspected or actual infringement of any trademark or trade name right, copyright, or other proprietary right.

Passwords
At the time your Account is opened, you must select a Password. You are responsible for maintaining the confidentiality of your Password and you are responsible for any harm resulting from your disclosure or allowing the disclosure of your Password or from use by any person of your Password to gain access to your Account and Account ID. At no time should you respond to an online request for a password. YNK will never ask for your password offline or online, except that you will be required to enter your password as part of the log-on process.
 
Charging Rohan Points to Your Account
The in-game cash currency is Crones. The payment method of Rohan is prepaid, meaning upon charging additional cash, you can purchase additional items and services in the form of Exchange Market transactions not exceeding your available balance. USD to RP exchange rate is 1:100. Available Cash types are Purchased Cash, Bonus/Admin/Mileage Cash, and E-Cash. Purchased Cash is the amount actually charged via the payment method of your choice. Bonus/Admin/Mileage Cash (free cash) are points awarded by administrators as bonuses and coupons. E-Cash are points obtained by selling products in the Exchange Market. Available cash-charge Payment Gateways (PGs) are PayPal, Pay by Cash, Click and Buy, Cherry Card, UtimateGameCard, and RPG Shops Card.

Users are to charge their RPs into their personal accounts having registered as members by agreeing to the User Agreement. YNK will not be held responsible and/or carry out rectification should we deem that the RPs are charged misappropriated or by errors resulting from Users misapplication during charging process or practices.

Charge Restrictions 
We may, at our discretion, impose daily and monthly spending limits on your account. Restrictions are placed according to the customer’s credit standing only with PayPal and Click and Buy to curb the perpetration of fraud. Other PGs are not subject to daily, monthly purchase limits or credit-rating filtering. When you feel your imposed limit on RPs is less than what you wish to spend, you may request a spending limit increase by contacting billing@ynkinteractive.com.

Cash can be purchased in multiples of $10, $25, $50, $100. Cash purchases are nontaxable (intangible sales).

Making Purchases Using RPs
Payment in the form of RPs will be applied to user’s account and deducted from user’s bank or credit card accounts when the transaction is successful.

When you make a payment, RPs will be deducted from your registered Account directly. If there are insufficient credits in your Account, the transaction will be denied.

Special Services Purchase
Special Services comprise character name-change service, gender-change service, penalty-initialization service. All services are available for purchase in as much as purchases do not exceed your remaining RP balance. Cash purchases are nontaxable (intangible sales).

Account Balances 
You are not required to maintain a minimum balance in your RPs. Balance remaining in your account will expire in 365 days following the last transaction performed.


Exchange Market
Exchange service refers to the P2P barter service enabling inter-user transactions for selling and buying characters, items and crones. Intra-exchange service transactions can be made with items not sold in the Item Mall. All transactions performed in Exchange Market service are performed with RPs, and cash refunds are not available. Price of products sold by sellers in a transaction is accrued as E-Cash. No transaction fees apply aside from the membership fee of $5 for buyer and seller respectively. No taxes apply to transaction amounts and fees.

Transaction Cancellations and Refunds
YNK offers no cancellations or refunds at any time. There are no exceptions.

Unauthorized Transactions 
You can review your transaction history at any time by logging in to your Account on YNK’s official Web site, and clicking the Purchase History tab. Notify YNK immediately if you have reason to believe any of the following activities has occurred:
(a) Unauthorized transactions made with your Account;
(b) Unauthorized access to your Account;
(c) Exposed Account password;
(d) Unauthorized transfer of money using your Account.
 
In cases where malicious activity occurs on a player's account due to unauthorized access the YNK support staff will investigate the incident within seven (7) days from the time of its occurrence. Investigations may last up to fourteen (14) days from the time the report is initially received. Accounts which are confirmed to have been legitimately compromised will receive a reimbursement of the virtual property that is either the same or closest to the verified to have been lost. Compromised account reports can be submitted to billing@ynkinteractive.com.

You are responsible for the security of your account. If you suspect your Account password has been exposed, we recommend changing both your Account password and secret question to prevent further access. Restorations will be limited to one incident per account. YNK reserves the right to alter its policy on unauthorized Account access at any time with or without notice.

To notify us if you believe there has been or will be an error or unauthorized transaction using your Account, contact us at billing@ynkinteractive.com. We will advise you of the results of our investigation within thirty (30) business days following your report submission.

Errors
If we discover a processing error, we will rectify the error. If the error resulted in RPs not deducted for a payment of service or goods, YNK will deduct the amount appropriately.

If the error resulted in our not completing a transaction on time or in the correct amount, we will rectify the situation promptly, unless:
(a) Through no fault of ours, you did not have enough available RPs to complete the transaction;
(b) Our system was not working properly and you knew about the breakdown when you started the transaction; or
(c) Circumstances beyond our control (such as fire or flood or loss of Internet connection) prevented the transaction, despite our reasonable precautions.


Account Termination
YNK, in its sole discretion, may terminate any Account at any time with or without notice. Should an Account be terminated, no refund will be provided to the Account holder or third parties for the remaining balance.

Restricted Activities
In connection with your use of our Web site, your Account, or the Services, or in the course of your interactions with YNK, a user or a third party, you will not:
(a) Breach this Agreement, the User Agreement and any other agreements that you have entered into with YNK (including policies);
(b) Violate any law, statute, ordinance, or regulation;
(c) Infringe or any third party's copyright, patent, trademark, trade secret or other intellectual property rights, or rights of publicity or privacy;
(d) Provide false, inaccurate or misleading information;
(e) Send or receive what YNK reasonably believe to be potentially fraudulent funds;
(f) Refuse to cooperate in an investigation or provide confirmation of your identity or any information you provide to YNK;
(g) Use your RPs or the Services in a manner that YNK reasonably believes to be an abuse of the YNK policies or a violation of e-payment and billing solutions;
(h) Facilitate any viruses, Trojan horses, worms or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or Information;
(i) Use any robot, spider, other automatic device, or manual process to monitor or copy our Web site without our prior written permission;
(j) Use any device, software or routine to bypass our robot exclusion headers, or interfere or attempt to interfere, with our Web site or the Services.

Your Liability

If you engage in any Restricted Activities, we may take various actions to protect YNK, users, third parties, or you from claims, fees, fines, penalties and any other liability. The actions we may take include but are not limited to the following:
(a) We may close, suspend, or limit your access to your Account or the Services (such as limiting access to any of your credits, and your ability to charge credits, make purchases, or remove personal Information);
(b) We may update inaccurate Information you provided us;
(c) We may refuse to provide our Services to you in the future;
(d) We may take legal action against you.

No Warranty
YNK, OUR PARENT, EMPLOYEES AND OUR SUPPLIERS PROVIDE OUR SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. YNK, OUR PARENT, EMPLOYEES AND OUR SUPPLIERS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

YNK does not have any control over the products or services that are paid for with our Services and YNK cannot ensure that a buyer or a seller you are dealing with will actually complete the transaction.

YNK does not guarantee continuous, uninterrupted or secure access to our Services, and operation of our site may be interfered with by numerous factors outside of our control.

YNK will make reasonable efforts to ensure that requests and transactions involving RPs are processed in a timely manner but makes no representations or warranties regarding the amount of time needed to complete processing because our Services are dependent upon many factors outside of our control, such including but not limited to technical difficulties and third parties.

Limitations of Liability
IN NO EVENT SHALL YNK, OUR PARENT, EMPLOYEES OR OUR SUPPLIERS BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH OUR WEB SITE, OUR SERVICES, OR THIS AGREEMENT (HOWEVER ARISING, INCLUDING NEGLIGENCE OUR LIABILITY, AND THE LIABILITY OF OUR PARENT, EMPLOYEES AND SUPPLIERS, TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCE IS LIMITED TO THE ACTUAL AMOUNT OF DIRECT DAMAGES).

YNK shall in no event be liable for any damages, loss or expense including without limitation, special damage, consequential damage, or economic loss arising from or in connection with:
(a) any access, use or the delay or inability to access or use of Services, or reliance on the materials and/or any other information contained related to the Services;
(b) any system, server or connection failure, error, omission, interruption, delay in transmission, or computer failure;
(c) any use of or access to any other Web site linked to
www.playrohan.com.

Disputes With YNK

If a dispute arises between you and YNK, we will be glad to assist and direct your concerns to solving your problems. Such disputes encompass Billing services only. Disputes between you and YNK regarding our Billing services may be reported to billing@ynkinteractive.com.

Indemnification
You agree to defend, indemnify and hold YNK, its parent, officers, directors and employees harmless from any claim or demand (including attorneys' fees) made or incurred by any third party due to or arising out of your breach of this Agreement and/or your use of the Services.

YNK, in its sole discretion, reserves the right to terminate this Agreement, access to its Web site, or access to the Services for any reason with or without notice.
